the performance of services for the execution and delivery of compositions of flowers

1 the Terms of service

1.1 "Flora Express" takes Orders containing the following information:

- the name and number of floral arrangements, in accordance with the data at the time of checkout on the website www.floraexpress.ru. If required by the Customer composition on the website were not available, the Customer describes the desired composition in arbitrary Order: names of flowers (plants), their number, additional materials (cellophane, bow, basket, etc.);

- date of delivery;

- Customer data: Name, Surname (company name), telephone number, e-mail. "Flora Express" have the right to request additional Customer data that identify the funds received from him for the payment of services;

- Recipient data: Name, Surname (company name), the exact delivery address, telephone number.

1.2 "Flora Express" guarantees delivery on the delivery date. In most cases the delivery is carried out from 10-00 to 21-00, if the Customer is not confirmed different time, early morning, late evening (extra charge). "Flora Express" seeks to fulfill the wishes of Customer on time delivery (delivery in the morning, afternoon or exact time), but can not accept claims for violation of delivery time for the selected date. Delivery at specific time interval a potential in the CIS and the Baltic States, in other countries delivery is carried out without time constraints.

1.3 "Flora Express" undertakes to make every effort to deliver the Order with:

- incorrect indication by the Customer of an address or indication of incomplete data necessary for the execution of the Order;

- the absence of the Recipient (for whatever reason) at the given address on the day of delivery (flowers may be left by any person in the apartment, neighbors, colleagues at work, on the porch (in foreign countries, this practice is the norm);

- refusal of Recipient to accept a floral arrangement.

If the above fails, the Order will be executed. Recognized as delivered, the Order is stored in a flower shop for three days and during this time, the Customer, Recipient or their representative can pick it up.

1.4 Orders with delivery to the hotel are delivered only to the entrance point of the hotel (reception). The order is considered delivered from the moment of transmission to reception and specifying the name and room number of the Recipient, further action on the delivery of the Order depends on the hotel. For its part, "Flora Express" tries to track the process of obtaining of the bouquet Recipient. If at the time of delivery of the Order the Recipient has checked out of the hotel, the Order is considered delivered. When Ordering delivery to a hotel, you must specify the unit number and the name of the person to whom the apartment was because the number was not always the Recipient.

1.5 "Flora Express" reserves the right to change the delivery date at the request of the Recipient. And in the case that at the time of the conversation with the recipient is no longer able to deliver to the address which informs the Recipient, and the recipient agreed on delivery at another date.

1.6 Flower arrangement presented on the website may differ from the delivered appearance, packaging, as each song creates an individual florist. Also the composition can vary in its composition of flowers and greenery in force beyond service reasons (the lack of a particular variety or color in connection with the season, other reasons). "Flora Express" reserves the right, without the consent of Customer, to produce an equivalent replacement of floral and packaging materials with the condition to preserve the overall appearance and value of flower arrangement. For flower arrangements of the same type (bouquet of roses), the flower type will prevail over color.

1.7 free "Photo delivery" is only available in most cities of the CIS and the Baltic States. If the service is the "Photo delivery" was not made for any reason (absence of the Recipient during delivery, the refusal of the Receiver, breaking the camera, etc.) "Flora Express" does not provide compensation to the Customer.

1.8 Card is an extra free attachment to the Order. If the card was allowed a grammatical or other error, or the card was lost or damaged in the delivery process for one reason or another, "Flora Express" in the shortest possible time by way of apology to the customer and the Recipient, delivers the correct card and apology box of chocolates. 1.9 "Flora Express" reserves the right, in its sole discretion, to refuse the Customer in placing his Order. The notice of refusal is sent by e-mail of the Customer specified when making the Order, within three days from the day of payment. Cash received from the Customer, "Flora Express" returns to the Customer the same way he paid.

1.10 the Order is completed in the absence of substantiated complaints and Customer complaints to quality of the delivered Order within 24 hours from the time of delivery. Notice of the Order comes to e-mail.

1.11 by Accepting this Offer by accepting, the Customer will receive the promotional materials, offering him as a client www.floraexpress.ru discounts, timed for the upcoming holidays. 1.12 All photos and videos that were made during the formation and delivery of the Order, belong to the "Flora Express" and can be placed on the website www.floraexpress.ruin social networks (Vkontakte, Facebook, Twitter, Instagram, etc.) on pages of official groups of "Flora Express", unless otherwise confirmed to the Customer via e-mail.

1.13 "Flora Express" reserves the right to attach to a running order promotional materials partners with special offers for the Recipient.

1.14 if the Customer has only a link to the profile of the Recipient on social networks, and "Flora Express" unable to contact Recipient to arrange delivery, the order will be cancelled. In this case the Customer shall be reimbursed for the cost of the order minus 10%, which are considered "Flora Express" as the cost of the actual costs of execution of the Order.

 

2 Cost of provision of services and payment

2.1 the cost of the Order is determined after registration on the website www.floraexpress.ru (see paragraph 1.1), based on the characteristics of the Order, prices and discounts referred to at the time of Ordering.

2.2 If the Order contains features that do not correspond to any of the proposals in www.floraexpress.ru (specified by the Customer address is outside of the city, which was specified during registration; the number of colors in the bouquet should be different etc), then the cost of the Order is additionally compatible with the Customer.

2.3 Payment must be made by the Customer advance payment in the amount of 100% (one hundred percent) and can be made in cash or non-cash (translated using payment cards, to the account of OOO "flora Express", electronic money, etc.).

2.4 in non-cash forms of payment the Order is considered paid after receipt of funds on the settlement account of OOO "flora Express". In exceptional cases the payment is confirmed if you have the scan copy of the payment order or the receipt of remittance to the account of the company through the Bank branch with seal of the Bank branch.

2.5 Privacy, security, and other terms associated with the selected Customer payment method is governed only by the contracts between the Customer and relevant organizations. For its part, "Flora Express" is doing everything it can to solve the problem between the Customer and a third party.

3 Obligations and responsibilities "Flora Express"

3.1 "Flora Express" undertakes to perform services for the design and delivery of compositions of flowers thus to ensure high-quality execution of Orders. Claims for the quality of the flowers taken within 24 hours of delivery if you have any photos of the delivered bouquet. Given the perishable nature of flowers, we will not be able to replace or refund the cost of the Order, if notice is not received within the stipulated time. Also note that the form of delivery signed by the Consignee upon delivery of the flowers contains the string "claims of quality delivered do not have" and a detailed description of the Order. "Flora Express" expects that if the quality of the flowers were unsatisfactory or not delivered goods correspond to the ordered, the Recipient will pay attention to it and make the appropriate notes on the form during receiving of the Order, not after.

3.2 "Flora Express" will, upon the request of the Customer to perform a pause of the Order and transfer the delivery to another date agreed with the Customer. The suspension Order, the Customer undertakes to inform 1 day before the originally designated date of delivery.

3.3 "Flora Express" does not accept any obligation in respect of the Order, not specified in the Offer. With the exception of cases when such commitments are recorded in writing and signed "Flora Express" and the Customer.

3.4 "Flora Express" is not responsible for:

- for late delivery of an Order in cases described in paragraphs 1.1 – 1.4 of this public Offer;

for any consequences caused by the payment method selected by the Customer;

for any damages and/or lost profits of the Customer and/or third parties, regardless of the fact that "Flora Express" could have foreseen the possibility of such damages;

- for the lack of delivery of your Order caused by circumstances of insuperable force (force majeure) including: actions of public authorities, fire, flood, earthquake, other natural actions, strikes, civil unrest, riots, lack of electricity and/or failures of the computer network, any other circumstances which may affect the execution of the Order.

3.5 In the event of failure of timely issued and paid for Order at fault "Flora Express" guaranteed refund, in full or by agreement with the Customer, the Order is delivered and due to the "Flora Express" Order is added to champagne or box of chocolates. If the Customer insists on a refund, then the aggregate liability of "Flora Express" is limited only by the amount paid by the Customer for the Order. 4 Obligations and liability of the Customer

4.1 the Customer shall place an Order in accordance with the terms described in paragraph 1.1 of this public Offer. The customer can independently complete the Order form on the website www.floraexpress.ru or use the services of the employee "Flora Express". When Ordering a member of the "Flora Express" the words of the Customer, the terms of the Offer shall be deemed accepted by the client.

4.2 the Customer undertakes to pay in accordance with section 2 of this Offer.

4.3 the Customer agrees when placing the Order comply with all regulations and requirements of the current legislation of the Russian Federation.

4.4 the Customer is responsible for:

- for late delivery of the Order, in case of default by the Customer of any of the terms of the Order (making the Order invalid data) described in paragraphs 1.1 – 1.4 of this public Offer;

for any consequences caused by the payment method that he chose;

- for failure to comply with the current legislation of the Russian Federation;

for the decision of all disputes, claims, lawsuits, injunctions received from third parties and/or authorities, in the execution of the Order placed by the Customer. 4.5 In case the Customer breaches the terms of the Offer "Flora Express" is entitled to suspend the execution of the Order, and "Flora Express" is entitled to recover from the Customer the cost of the services received by the Customer prior to the suspension of the Order.

4.6 In the event of cancellation for reasons beyond "Flora Express" reasons for refunds "Flora Express" the right to keep the cost of the actual expenditure under this Order.

4.7 the Client agrees and accepts the privacy policy, which reglamentary the collection, storage and processing of personal data of the Customer.

 

5 Warranty

5.1 "Flora Express" will make every effort to fulfill the Order in accordance with the wishes specified by the Customer, but does not guarantee absolutely exact their execution.

5.2 "Flora Express" will make every effort to carry out the Order, which delivery must be made on the day of booking. These Orders "Flora Express" takes in the CIS and the Baltic States to 14.00 at the time of the settlement, where scheduled delivery; the rest of the world until 12.00 local time. Delivery is possible, ask the employee "Flora Express".

5.3 "Flora Express" guarantees that Customer personal data is collected, stored and processed according to the privacy policy.

5.4 Upon the execution of the Order "Flora Express" can get the Recipient's information (Name, Surname, organization Name, telephone number, delivery address, but is not limited to) that is confidential and is not transferable to the Customer and/or third parties without explicit permission from the Recipient.

5.5 by Accepting this Offer by accepting, the Customer warrants that:

- has all the rights and powers necessary to accept the terms of this Offer;

- fully acquainted with the terms of the Offer and accepts them voluntarily;

- understands the significance and consequences of their actions in relation to the conclusion and execution of the services described in this agreement;

- uses accurate data during the Ordering and payment documents on the basis of which the payment Order.

5.6 except For the warranties expressly set forth in the Offer, "Flora Express" does not provide and specifically disclaims any other Express or implied warranties or conditions in respect of conformity of the services to specific purposes of the Customer, or their suitability for other purposes and tasks.

 

6 other conditions

6.1 the agreement becomes effective upon publication on the website www.floraexpress.ru on the Internet at the address /EN/page/public-offer and is valid until its revocation. To withdraw and/or amend the Offer is only entitled to the company "flora Express". The changes will come into force upon their publication on the website.

6.2 Any notice required or permitted by this Offer, shall be made only in writing in Russian and English and sent to the notify party by email.

6.3 Disputes and disagreements that may arise in the performance of the services described in this agreement will be settled through negotiations between the parties. All the issues unresolved by the Offer or negotiations, be governed by the laws of the Russian Federation.

6.4 Dear customers, please note that if you order flower delivery day-to-day in the country with a large time difference, the composition of the bouquet can be changed in favor of delivery of order in desired time.

6.5 during the holidays "Flora Express" reserves the right to carry out a preliminary call with the recipient for several days prior to the date of delivery for timely execution of the order.
